Supreme Court rejects plea on PM Cares Fund, will not transfer money to NDRF

The money deposited in pm cares fund cannot be transferred to the National Disaster Relief Fund (NDRF). The Apex court dismissed the petition filed in this regard. The PM Cares Fund Trust has been formed towards the central government to fight the corona epidemic.

The Supreme Court had on June 17 reserved its verdict on a PIL filed by the Centre for Public Interest Litigation (CPIL). The petition sought transfer of money deposited in pm Cares Fund to NDRF fund.

In a previous hearing held in the Supreme Court, the central government had defended the fund. Filing an affidavit in the Supreme Court, the central government had said that there was no ban on the creation of PM care funds. Pm care funds do not prohibit other funds at the time of national or state disaster. People can voluntarily donate to this fund. Therefore, the demand for transfer of all money to NDRF is not a hearingable one. The central government had sought rejection of the PIL filed in the case.

While defending the case on behalf of cpil, senior advocate Prashant Bhushan had levelled allegations against the central government for several irregularities. Prashant Bhushan said the Union government should prepare a national plan to include Covid-19 as per the DMA. In this scheme, the Centre should issue minimum standards for relief. All receipts of PM Care Fund should be audited by cag and the information should be made public. The amount that has not been disclosed. All of them should be transferred to the NDRF fund.
